ViralPop AI Art Publisher — Terms of Service

1. About These Terms

These Terms of Service (“Terms”) govern the use of ViralPop AI Art Publisher, an application operated by DigitalClub to automate the publication of ViralPop’s own content on its Facebook Page, Instagram account, and YouTube channel.

ViralPop AI Art Publisher is intended for DigitalClub’s own publishing operations and authorized administrators. It does not provide social media account connection or publishing services to third-party users.

By accessing or using the application, you agree to these Terms. If you do not agree with these Terms, you should not use the application.

2. Purpose of the Application

ViralPop AI Art Publisher provides automated publishing functionality that may include:

• Uploading and publishing images, videos, captions, titles, descriptions, tags, and related metadata.
• Publishing content to authorized Facebook Pages and Instagram accounts.
• Uploading and publishing videos to authorized YouTube channels.
• Checking upload, processing, and publication status.
• Recording publication identifiers, links, timestamps, status information, and operational errors.
• Supporting automated workflows necessary to prepare and publish ViralPop content.

The application is an internal publishing integration and is not a replacement for Facebook, Instagram, YouTube, or their respective account-management tools.

3. Authorized Use

The application may only be used by DigitalClub and persons authorized by DigitalClub to manage ViralPop publishing operations.

Authorized administrators are responsible for:

• Maintaining the confidentiality and security of their credentials.
• Using only accounts and channels they are authorized to manage.
• Ensuring that publication instructions are accurate.
• Reviewing content when appropriate before publication.
• Complying with applicable laws, platform rules, and intellectual-property requirements.

You may not use the application to gain unauthorized access to an account, circumvent platform restrictions, interfere with third-party services, or engage in unlawful or abusive activity.

4. Content and Intellectual Property

DigitalClub retains its rights in original content, software, branding, workflows, and other materials created or owned by DigitalClub or ViralPop.

The use of ViralPop AI Art Publisher does not transfer ownership of content to Meta, Google, YouTube, or other service providers except for licenses or rights necessary to provide their services under their respective terms.

Authorized administrators must ensure that content submitted for publication is owned by DigitalClub, appropriately licensed, or otherwise authorized for publication.

Content must not knowingly infringe copyrights, trademarks, privacy rights, publicity rights, or other rights of third parties.

5. Artificial Intelligence and Generated Content

ViralPop content may include material created or modified using artificial-intelligence tools.

Where a destination platform requires disclosure, labeling, audience designation, or other information concerning synthetic, altered, or AI-generated content, the application or authorized administrator should provide the applicable information.

Use of AI-assisted content does not remove the responsibility to ensure that published material complies with applicable laws and the rules of the destination platform.

6. Third-Party Platforms and Services

ViralPop AI Art Publisher relies on third-party platforms and services, including Meta’s Facebook and Instagram services and Google’s YouTube API Services.

Use of these services is also governed by the terms, policies, and technical requirements established by their respective providers.

DigitalClub does not control the availability, functionality, policies, quotas, restrictions, or technical operation of these third-party services. Changes made by a provider may affect or interrupt ViralPop AI Art Publisher functionality.

7. Google and YouTube

ViralPop AI Art Publisher uses YouTube API Services to upload and publish ViralPop videos and associated metadata to an authorized YouTube channel.

By using functionality that interacts with YouTube, authorized administrators also agree to comply with the YouTube Terms of Service:

Use of the YouTube API Services is also subject to Google and YouTube policies applicable to API clients, including the YouTube API Services Terms of Service and Developer Policies.

Authorized administrators may revoke the application's access to their Google account through Google Account permissions:

ViralPop AI Art Publisher must not be used to circumvent YouTube restrictions, quotas, security mechanisms, Community Guidelines, or other applicable YouTube requirements.

8. Facebook and Instagram

ViralPop AI Art Publisher may use Meta APIs and related services to publish authorized content to ViralPop’s Facebook Page and Instagram account.

Use of those services remains subject to the applicable Meta, Facebook, and Instagram terms, policies, permissions, and technical limitations.

Revoking Meta permissions or changing account, Page, application, or business settings may interrupt the application's ability to publish content.

9. Privacy and Data Handling

Information processed through ViralPop AI Art Publisher is handled according to the ViralPop AI Art Publisher Privacy Policy.

The Privacy Policy describes the information processed by the application, how it is used, applicable retention practices, deletion procedures, and methods for revoking access.

The current Privacy Policy is available through the ViralPop website and should be reviewed together with these Terms.

10. Availability and Changes to the Service

DigitalClub may modify, suspend, update, or discontinue any part of ViralPop AI Art Publisher when necessary for operational, technical, security, legal, or platform-compliance reasons.

We do not guarantee that the application or any third-party service it relies upon will always be available, uninterrupted, error-free, or compatible with future changes made by third-party platforms.

11. Security

Authorized administrators must take reasonable measures to protect account credentials, OAuth authorizations, access tokens, devices, and systems used to access the application.

Suspected unauthorized access, credential exposure, or security incidents affecting ViralPop AI Art Publisher should be reported promptly to DigitalClub.

12. Disclaimer

ViralPop AI Art Publisher is provided on an “as available” basis.

To the extent permitted by applicable law, DigitalClub does not guarantee uninterrupted operation, successful publication of every item, continued availability of third-party APIs, or the absence of technical errors.

Content publication may fail or be delayed because of network conditions, API limitations, account restrictions, quota limitations, third-party platform changes, processing failures, or other circumstances outside DigitalClub’s direct control.

13. Limitation of Liability

To the extent permitted by applicable law, DigitalClub will not be liable for indirect, incidental, special, consequential, or similar damages arising from the use or inability to use ViralPop AI Art Publisher.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

14. Suspension or Termination

DigitalClub may suspend or terminate access to ViralPop AI Art Publisher when necessary to protect the application, connected accounts, third-party platforms, or DigitalClub’s operations, or when use violates these Terms or applicable platform requirements.

Access may also cease if authorization to a connected Facebook, Instagram, Google, or YouTube account is revoked.

15. Changes to These Terms

DigitalClub may update these Terms when the application, applicable laws, third-party services, or platform requirements change.

Updated Terms will be published on this page with a revised “Last updated” date.

Continued use of the application after an update constitutes acceptance of the revised Terms to the extent permitted by applicable law.
